This Privacy Policy has been prepared by Williams Sonoma, Pottery Barn, pottery barn kids, PBteen, west elm, Rejuvenation and Mark & Graham which are each owned and operated by Williams-Sonoma Canada, Inc. (“WSI Brands”, “we”, “us”, “our”). We are committed to respecting your privacy. The purpose of this Privacy Policy is to inform you what information we may collect from you, how we use and disclose such information, and the choices you have regarding our use of, and your ability to access, review, correct and opt out of our use of, the information. This Privacy Policy applies to our privacy practices in our stores, on our websites available at  www.williams-sonoma.ca, www.potterybarn.ca, www.potterybarnkids.ca, www.pbteen.ca, www.westelm.ca, www.rejuvenationhome.ca and www.markandgraham.ca and through other interactions with you such as email and phone.

Collecting and Using Information About You

The term “personal information” means information about an identifiable individual, including name, address, email address, signature, and other information relating to an individual. We may collect and use personal information when you:

  • purchase or order a product;
  • create a gift registry;
  • sign-up to receive promotional email or other communications
  • register to receive catalogues or to attend an event;
  • participate in contests, sweepstakes or promotions;
  • participate in surveys or customer research;
  • visit or register on our website;
  • apply for employment; or
  • contact our customer service department with a comment, question or complaint.

To serve you better, we may combine information you give us online, in our stores or through our catalogues. We may also combine information with publicly available information or other information we receive from third parties, including providers of third party cookie and other third party browsing and use data as set out under “Online Ads/Interest-Based Advertising” below. We use that combined information to enhance and personalize the shopping experience of you and others with us, and to recognize our customers so that we can communicate with you about our products and events that may be of interest to you, and for other promotional purposes. We also use information for internal purposes, such as analyzing preferences, trends, and statistics to help us better understand our customers and to enhance our product and service offerings.

Purchase Or Order A Product

You do not have to provide us with any personal information when you purchase merchandise with cash at one of our stores. If you use a credit or debit card for your purchase, we collect your debit or credit card-related information and your signature to process and administer your payment. If you make a purchase online, we also collect your shipping and billing address, telephone number and email address in order to arrange shipment of your order, track your order, contact you about your order and for fraud prevention purposes. If you purchase a gift card on one of our websites, we may also collect the name and email address of the recipient in order to deliver the gift card on your behalf. We maintain a record of your product purchases to facilitate merchandise returns, and to better understand your preferences and tailor our communications to you.

Create A Gift Registry

If you choose to create a gift registry, we collect personal information in order to administer your registry account and arrange for delivery of gift items. The information we collect includes your (and your co-registrant’s) name, mailing address, phone number, email address, event type and date, shipping information, and the items in your registry.

Visit Our Stores

We use CCTV cameras in our stores to collect video recordings for security and loss prevention purposes. For more information, please contact us using the contact information set out at the end of this policy.

Sign-Up For Promotional Communications

We may offer you the ability to sign-up to receive marketing and promotional communications through our website or on third party websites (including through social media sites). If you sign-up, we collect certain personal information (such as first and last name, email address or mobile phone number) which we use to send you email, text message or other communications containing updates regarding products and services, special promotions or upcoming events that may be of interest to you. From time to time, we may also collect optional demographic information or information about your personal interests or preferences. If you choose to provide this information, we use it to tailor our communications to you.

You can opt-out of receiving promotional email from us by following the opt-out or “unsubscribe” instructions provided in your email or text message, or by contacting us as set out below. Please note that you may continue to receive transactional or account related messages from us.

We may use “refer a friend” and other similar features on the Services to permit you to send email to others individuals that might be interested in WSI Brands. This feature requires you to submit your name and email address, as well as the name and email address of the recipient. We do not use the names or email addresses submitted in these circumstances for any other purpose without the consent of you or the email recipient to do so. Please ensure that you only submit email addresses of individuals with whom you have a personal or family relationship and who would want to receive the message.

We contact you only in ways compatible with your communications choices. We rely on you to ensure that your contact information is accurate, complete, current, and otherwise reliable. To update or correct your contact information, please contact us as set out below.

Create An Online Account

You do not have to create an online account to visit and browse our websites. However, to access certain features on our websites, you may be required to create an account and provide your name, email address and a password you choose. We use this information in order to create and administer your online account. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls or email messages).

Catalogues And Events

If you register to receive a catalogue or attend an event, we collect information such as your name, mailing address or email address. We use this information to add you to our catalogue mailing list, and/or to facilitate your registration for the event.

Contests, Sweepstakes And Promotions

When you enter a contest, sweepstakes or participate in a promotion, we may collect your name, address, phone number, email address, and other information you provide. We use this information to administer your participation in the contest, sweepstakes or promotion. At the time you enter the contest, sweepstakes or promotion, we may obtain your consent to send you future promotional communications.

Surveys And Customer Research

From time to time, we may offer you the opportunity to participate in one of our surveys or other customer research. The information obtained through our surveys and customer research is used in an aggregated, non-personally identifiable form. We use this information to help us understand our customers, to enhance our product and service offerings, promotions and events, and/or to assist in the selection of store locations.

Apply For Employment

In connection with a job application or related inquiry regarding potential employment with WSI Brands, you may provide us with certain personal information about yourself (such as that contained in a resume, cover letter, or similar employment-related materials). We use this information for the purpose of processing and responding to your application for current and future career opportunities.

Customer Service

When you contact us with a comment, question or complaint or use our live chat feature, you may be asked for information that identifies you (such as your name, address and a phone number) along with additional information we need to help us promptly answer your question or respond to your comment or complaint. We may also retain this information to assist you in the future and to improve our customer service, product and service offerings, and events and promotions.

Sharing Of Personal Information

We will not disclose, trade, rent, sell or otherwise transfer your personal information, without your consent, except as set out herein.

Service Providers: We may transfer (or otherwise make available) your personal information to third parties who provide services on our behalf. For example, we may use service providers to send our emails, provide marketing and advertising services, process payments, provide shipping services, host our website and operate certain of its features or perform data analysis and management. Your personal information may be maintained and processed by third party service providers in the US or other jurisdictions. Our service providers are given the information they need to perform their designated functions, and we do not authorize them to use or disclose personal information for their own marketing or other purposes.

Select Partners: From time to time we might establish a business relationship with other persons or entities whom we believe trustworthy and whom we have asked to confirm that their privacy policies are consistent with ours. These are known as our Select Partners. In such cases, with your consent, we might share and/or cross-reference information, including contact information about you that will enable such persons or entities to contact you regarding products and services that may be of interest to you. This section does not apply to mobile phone numbers and opt in consent information collected for SMS text programs. Williams-Sonoma Canada, Inc.Brands may also collect mobile phone numbers for other purposes which are subject to this section.

Our Affiliates: We may share personal information with businesses controlling, controlled by, or under common control with any Williams-Sonoma, Inc. Brands.

Business Transactions: We may transfer any information we have about you as an asset in connection with a proposed or completed merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of Williams-Sonoma Canada, Inc., Williams-Sonoma, Inc., or as part of a corporate reorganization or other change in corporate control.

Legal Requirements: WSI Brands and our Canadian, US and other service providers may provide your personal information in response to a search warrant or other legally valid inquiry or order, or to an organization in the case of a breach of an agreement or contravention of law, or as otherwise required or permitted by applicable Canadian, US or other law. We may also disclose personal information where necessary for the establishment, exercise or defence of legal claims, to detect, suppress or prevent fraud, and to investigate or prevent actual or suspected loss or harm to persons or property.

Website Information, Social Media, Cookies And Other Tracking Technologies

In general, you can visit many of our web pages without telling us who you are or revealing any contact information about yourself. We may track the Internet domain address from which people visit us, IP (Internet Protocol) address, other electronic markers and device identifiers. We also collect other information about our website traffic including information such as page requests, browser or device type, operating system and average time spent on our web site. We may analyze this data for preferences, trends, site usage statistics and to recognize you when you return to the web site (if you have registered on the web site). With your consent, we may also collect location data from your mobile phone or other device you use to access our web sites in order to provide you with location-based features, such as the closest store location.  We may combine this information with other information in order to better understand our customers and customize our offers.

Social Media: If you engage with our content on or through third-party social networking websites or applications, you may allow us to have access to certain information associated with your social media account (e.g., name, username, email address, profile picture) to deliver the content or as part of the operation of the website or application.

Cookies: When you visit our web sites, we send one or more cookies to your computer or other device. We may also use cookies and other similar technologies in emails that you receive from us. A cookie is a small data file that is placed on the hard drive of your computer when you visit a web site. A session cookie expires immediately when you end your session (i.e., close your browser). A persistent cookie stores information on the hard drive so when you end your session and return to the same web site at a later date the cookie information is still available. We use cookies to improve the quality of our service when you visit our web site. Tracer Tags & Web Beacons: Our website may also use a technology called "tracer tags" or “Web Beacons”. This technology allows us to understand which pages you visit on our website. Online Ads/Interest-Based Advertising

These companies may use cookies, tracer tags or web beacons to report certain information about your visits to our website and other websites (such as web pages you visit and your response to ads) in order to measure the effectiveness of our marketing campaigns and to deliver ads that are likely to be more relevant to you, both on and off our website (including on social media sites). Opting Out Of Marketing And Transfers; Updating And Deleting Information About You

We want to communicate with you only if you want to hear from us. If you would like to withdraw your consent to receive marketing communications from any of our brands, you can call us at 1 (855) 860-1081 or send us an email international@potterybarnkids.com. Please be sure to include your full name, email address, mailing address, and specifically what information you do not want to receive and from which of our brands. If you like, you may use one of the following statements in your message to us:

  • I prefer not to receive marketing email communications, such as updates regarding products and services, special promotions or upcoming events.
  • I prefer not to receive direct mail, such as periodic catalogues and mailings regarding products and services, special promotions or upcoming events.

You may also click the designated link or instructions included in all email and text messaging communications to be removed from future marketing email or text message updates. Please note that you may continue to receive transactional and account-related electronic messages from us and we may need to contact you via phone, email or mail to address questions or issues specific to your order, entry, etc., even if you have opted to not receive marketing communications from us.

Please note that you may continue to receive communications (such as mailed catalogues) while your opt-out request is being processed.

Access To Your Personal Information and Your Rights

You have the right to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. You may request access, updating and corrections of inaccuracies in the personal information we have about you in our custody or control by emailing or writing to us at the contact information set out under “Contact Us” below, please visit https://wsi.truyo.com. Note that you may also update certain contact information by logging into your online account, which may be faster than submitting a request. In order to verify your identity, you will need to provide at least three of the following pieces of your information: name, telephone number, e-mail address, mailing address, and last transaction amount. We will match this information to the information on our systems. We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records. In some cases we may not be able to allow you to access certain personal information in certain circumstances, for example if it contains personal information of other persons, or for legal reasons. To help protect against fraudulent requests for access to your personal information, we may ask you for information to allow us to confirm that the person making the request is you or is authorized to access your information before granting access. For example, we may require you to verify your identity before you access your personal information.

You may also request to withdraw your consent to our collection, use and disclosure of your personal information, subject to legal or contractual restrictions by sending us a request to the Contact Us section of this Privacy Policy. Please note that if you withdraw your consent, we may no longer be able to provide certain services to you. If you withdraw your consent, we may retain your personal information in accordance with our internal records retention processes and to meet our legal obligations.

Safeguards And Retention

We maintain reasonable physical, electronic, and procedural safeguards to protect the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure.
